MEMORANDUM OF UNDERSTANDING BETWEEN THE TAIPEI REPRESENTATIVE OFFICE IN THE UK AND THE BRITISH TRADE AND CULTURAL OFFICE, TAIPEI ON COOPERATION IN INTELLECTUAL PROPERTY RIGHTS-1

In light of the importance of international cooperation onintellectual property in supporting the development of industry,technology and the economy;Desiring to take into account the need to promote effective andadequate protection of intellectual property rights asacknowledged in the Agreement on Trade-Related Aspects ofIntellectual Property Rights (“ TRIPS ” );Understanding that intellectual property rights (“ IPR ” )asreferred to in this Memorandum of Understanding, include any andall those rights covered by TRIPS but excluding rights relatedto the protection of plant varieties;The Taipei Representative Office in the UK and the British Tradeand Cultural Office, Taipei (hereinafter referred to as “ theTRO ” and “ the BTCO ” ), acting on behalf of the relevantauthorities in Taiwan and the United Kingdom respectively,hereby have reached the following understandings to establishthe following arrangements:Paragraph 1The relevant authorities of both sides will exchange views oninternational IP related issues, such as internet piracy, patentlaw harmonization, and issues discussed at WTO, WIPO and otherinternational fora.Paragraph 2The relevant authorities of both sides will exchange informationon changes made to IPR legislation and to their operationalpractices under that legislation, and on notable developments incase laws, in English where possible.Paragraph 3The relevant authorities of both sides will exchange officialIPR publications including periodicals gazettes and pamphlets,in English where possible.Paragraph 4Subject to the availability of resources, the relevantauthorities of both sides will consider the feasibility ofextending cooperation in areas of mutual interest through ajoint workplan.Paragraph 5This Memorandum of Understanding will come into effect on thedate of the last signature.Either side may terminate this Memorandum of Understanding bygiving the other side six months written notice.
